Software licensing terms for Cyber Security Stack products
Subject to the terms of this Agreement, Cyber Security Stack Ltd grants you a limited, non-exclusive, non-transferable license to use the Resonance Protocol software and MBDR technology.
This license permits installation and use on devices you own or control for your internal business operations.
You may not sublicense, sell, rent, lease, or otherwise transfer the software to third parties.
The license is contingent upon your compliance with all terms and conditions outlined in this agreement.
You may not reverse engineer, decompile, or disassemble the software, except to the extent expressly permitted by applicable law.
Modification, adaptation, translation, or creation of derivative works based on the software is prohibited.
Removal, alteration, or obscuring of any proprietary notices, labels, or marks is not permitted.
Use of the software for any unlawful purpose or in violation of any applicable regulations is strictly forbidden.
Bypassing or circumventing any security measures or technical limitations is prohibited.
All intellectual property rights in the software, including the Resonance Protocol and MBDR technology, remain the exclusive property of Cyber Security Stack Ltd.
This agreement does not grant you any rights to patents, copyrights, trade secrets, trademarks, or any other intellectual property.
Any feedback, suggestions, or improvements you provide may be used by Cyber Security Stack without obligation or compensation.
The Cyber Security Stack name, logo, and all related trademarks are owned by Cyber Security Stack Ltd and may not be used without prior written consent.
The software may collect certain operational data, including system performance metrics, security event logs, and usage statistics.
All data collection is subject to our Privacy Policy and Data Processing Agreement.
You retain ownership of all data processed through the software, including security intelligence and threat detection data.
We implement industry-standard encryption and security measures to protect your data.
You have the right to access, modify, or request deletion of your data in accordance with applicable data protection laws.
Cyber Security Stack may provide updates, patches, and new versions of the software at its discretion.
You agree to install critical security updates within a reasonable timeframe.
Updates may modify, add, or remove features and functionality.
Continued use of outdated software versions may void certain warranty provisions.
Technical support is provided according to your service level agreement or subscription plan.
The software is provided 'as is' without warranties of any kind, either express or implied.
We do not warrant that the software will be error-free, uninterrupted, or meet your specific requirements.
While the software is designed to enhance cybersecurity, we cannot guarantee complete protection against all threats.
You acknowledge that no security solution can provide absolute protection and accept responsibility for implementing comprehensive security measures.
Any implied warranties of merchantability, fitness for a particular purpose, and non-infringement are expressly disclaimed to the maximum extent permitted by law.
In no event shall Cyber Security Stack be liable for any indirect, incidental, special, consequential, or punitive damages.
This includes, but is not limited to, loss of profits, data, business interruption, or security breaches.
Our total aggregate liability shall not exceed the amount paid by you for the software in the twelve months preceding the claim.
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so these limitations may not apply to you.
You agree to indemnify and hold harmless Cyber Security Stack from any claims arising from your use of the software.
This agreement is effective upon your acceptance and continues until terminated.
You may terminate this agreement by ceasing all use of the software and destroying all copies.
We may terminate this agreement immediately if you breach any terms or conditions.
Upon termination, you must cease all use of the software and delete or destroy all copies in your possession.
Provisions regarding intellectual property, warranties, liability limitations, and dispute resolution survive termination.
This End User License Agreement shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
Any disputes arising from or relating to this agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.
By installing or using the software, you acknowledge that you have read, understood, and agree to be bound by the terms of this agreement.
